- Spouse / Civil Partnership
- This visa category gives you the permission for leave to enter or remain in the UK as a spouse or a civil partner of a present and settled person in the UK or who is on the same occasion being admitted for settlement.
- This visa category will give you the provision to live and work in the UK up to 2 years.
- This period is called “The Probationary Period”
- At the end of the probationary period you are eligible to apply for Indefinite Leave to Remain (ILR) as long as your marriage or civil partnership is still subsisting.
- However if you have been married or been in a civil partnership over 4 years with your sponsor who is a British citizen or a permanent resident of the UK and entering to UK at the same time as you; you may not have to full fill the “ Probationary Period” . In this circumstance you are eligible to apply for the UK Indefinite Leave to Remain (ILR) status straightaway.

- You or your sponsor should not be age under 21 when you enter to the UK as a Spouse or Civil Partner or when you vary your visa to Spouse or Civil Partner.
- Your spouse or civil partner is a present and a settled person in the UK or who is on the same occasion being admitted for settlement.
- You must be legally married or entered in to Civil Partnership with your sponsor who is a present and settled person in the UK.
- Both parties must be met.
- Each party intend to live permanently with each other as far as the marriage or civil partnership is subsisting.
